MY RECORDS ARE MINE, RIGHT?
CHAPTER 611 AND 
ETHICAL CONSIDERATIONS FOR RELEASE OF RECORDS IN TEXAS

As professional counselors it is our responsibility to familiarize ourselves with all relevant code sections related to licensure.  One of the sections is Chapter 611 of the Texas Health and Safety Code as it pertains to mental health records.  Improper handling of records resulting in breach of confidentiality and failure to release records are some of the primary complaints filed against LPCs and LPC Associates in Texas.  In this presentation Texas Mental Health Counselor Association (TMHCA) President, Dr. Olivia Wedel, will review Chapter 611 and share some of the ethical pitfalls that lead to failing to follow the code section as required.  The presentation includes information on what must be included in your informed consent documents around release of records, what happens if a complaint is filed against your license, and best practices for documentation.  Participants will have the opportunity to review a brief ethics case  study and determine how to respond based on Chapter 611.  The presentation will conclude with a brief update of the Texas Legislative Session and recent LPC rule changes that are effective March 7, 2023.  Time will be dedicated for questions at the end and various handouts will be provided.
